Please read these terms and conditions (“Terms”) carefully before using ABCAP’s (“we,” “us,” or “our”) directory website located at abcap.org.uk (the “Site”). These Terms govern your use of the Site, and by accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
a. Eligibility: You must be at least 18 years old to use this Site. By using the Site, you agree that you are of legal age and have the legal capacity to enter into these Terms.
b. Access and Accounts: You may be required to create an account to access certain features of the Site. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
c. Prohibited Activities: You agree not to engage in any of the following activities while using the Site:
a. Accuracy of Information: If you submit a listing or content to our directory, you represent and warrant that all information provided is accurate, complete, and up to date at the time of submission. You are solely responsible for the content you submit.
b. Ongoing Accuracy Obligations: You are responsible for ensuring that your directory listing remains accurate and up to date throughout your membership. You must notify ABCAP promptly if any information in your listing changes, including (without limitation) your qualifications, professional body membership, professional indemnity insurance, or contact details. ABCAP does not actively monitor changes to member information after the point of joining.
c. Verification: As part of the membership application process, ABCAP will verify the information you provide, including evidence of your qualifications or study towards qualifications, professional body membership (where applicable), and professional indemnity insurance. Membership is conditional on this information being accurate and complete. You must notify ABCAP immediately if your qualifications, professional body membership, insurance, or fitness to practise is compromised, suspended, lapsed, or withdrawn.
d. False or Misleading Information: Providing false or misleading information in connection with a membership application or an existing listing is a serious breach of these Terms and will result in the immediate termination of your membership and removal of your listing, with no right of appeal.
e. Rights to Content: By submitting a listing or content to the Site, you grant ABCAP a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, modify, and distribute that content in connection with the operation of the Site and ABCAP’s services.
a. Members may access a maximum of one CPD course simultaneously, with a maximum of 12 courses per year.
b. Certificates are valid for one year; renewal is recommended to ensure continued recognition.
c. ABCAP makes reasonable efforts to ensure that learning materials are accurate and useful, but does not guarantee that materials are error free. If errors are found, please contact us.
d. ABCAP reserves the right to refuse access to ABCAP Learn at its discretion.
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your data as described in the Privacy Policy.
a. All content and materials on the Site, including but not limited to text, graphics, logos, and software, are the property of ABCAP or its licensors and are protected by copyright, trademark, and other intellectual property laws.
b. You are granted a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes only. This licence does not include the right to modify, reproduce, distribute, or create derivative works from any Site content.
a. Code of Ethics: All individual members are required to comply with ABCAP’s Code of Ethics, which is incorporated into these Terms by reference. The Code of Ethics sets out the professional and ethical standards expected of ABCAP members.
b. Conduct Standards: Members must conduct themselves professionally at all times in their capacity as therapists and as ABCAP members. This includes (without limitation):
a. Discretionary Right: ABCAP reserves the right to suspend or permanently remove any directory listing, and to terminate membership, at its sole discretion, at any time and for any reason, including (without limitation):
b. No Obligation to Investigate: ABCAP is not required to investigate any allegation or make any finding of fact before exercising its right to suspend or remove a listing or terminate membership. A decision to suspend or remove a listing is a private contractual act and does not constitute a finding of misconduct or wrongdoing.
c. Notice and Opportunity to Respond: Where practicable and where it would not compromise public safety, ABCAP will notify the member in writing before removing their listing and provide a reasonable opportunity to respond. This clause does not apply where:
d. Removal of Credentials: On termination of membership for any reason, you must immediately cease using ABCAP’s name, logo, membership certificates, and credentials in all materials, including your website, social media profiles, letterheads, email signatures, and all other communications.
e. Appeals: A member whose listing has been removed or whose membership has been terminated may appeal the decision on procedural grounds only within 14 days of receiving notification, by writing to info@abcap.org.uk. An appeal may only challenge whether ABCAP followed its own procedures; it is not a review of the merits of the decision. The outcome of any appeal is final. The right of appeal does not apply where membership has been terminated under clause 2d (false or misleading information).
a. The Site and its content are provided “as is” and “as available” without any warranties of any kind, whether express or implied.
b. ABCAP does not endorse and is not responsible for the accuracy or reliability of any content submitted by third parties, including member listings. ABCAP verifies member information at the point of joining but does not actively monitor or guarantee the ongoing accuracy of listing content.
c. Directory Disclaimer: ABCAP is not a regulatory body. Listing in the ABCAP directory does not constitute a representation that a therapist is currently fit to practise, holds current insurance, or remains in good standing with any professional body. We strongly recommend that you verify a therapist’s qualifications, professional body membership, and professional indemnity insurance directly before your first session.
To the fullest extent permitted by law, ABCAP shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Site, including any reliance on directory listings or member content.
a. Your membership will continue and automatically renew on a monthly or annual basis (depending on your plan) unless you cancel in accordance with clause 11.
b. By enrolling in membership, you agree that all membership fees are due and payable according to your plan, regardless of whether you have submitted any required documents or completed any verification process.
c. When your membership renews, we will automatically charge your payment method on file for the membership fee on the calendar day corresponding to the commencement of your paying membership.
d. Member packs (including digital certificates and member badges) are available upon request. Members who wish to receive their most up-to-date membership certificate can do so by contacting us.
e. We reserve the right to change the timing of our billing, including where your payment method has not successfully settled.
f. You are responsible for ensuring that your payment details remain valid and up to date. Failure to do so may result in suspension or termination of your membership.
g. Non-Payment: If a membership fee is not paid within 10 days of falling due, your listing may be automatically suspended until payment is received. If payment is not received within a further period specified by ABCAP, your membership may be terminated.
a. Membership payments have a 14-day cooling-off period from the date of payment, during which you may cancel and receive a refund of your most recent payment.
b. Refunds within the 14-day cooling-off period cover the most recent payment only.
c. Cancellations requested outside of the 14-day period are not eligible for any refund or pro-rated reimbursement for the remaining portion of the billing cycle.
d. To cancel, you must notify ABCAP by email using the contact form. Cancellation through your member profile alone is not sufficient.
e. Personalised goods (such as printed membership certificates) are exempt from the 14-day cooling-off right.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
